Form I-9 Expires August 31. Can You Still Use It?
Use the current form
You have likely see the expiration notice on the top right of Form I-9.

However, according to the U.S. Citizenship and Immigration Services I-9 website (See under Forms Updates along the left side of the webpage), the form is still valid until the USCIC releases a new edition: “We will publish a new edition of this form soon. In the meantime, you may file using the 07/17/17 edition.”
Checking the version you are using is easy. You can find the version date at the bottom left on all pages of the form and the instructions.
So, following past practice, until the Department of Homeland Security issues an update and as long as you’re using the current 07/17/17 version with the 8/31/2019 expiration date, you’re good to go even after the expiration date passes.
Expected update
According to a recent Society for Human Resource Management (SHRM) article, the Department of Homeland Security (DHS) is expected to extend the current version (marked 8/31/2019) as is. Some minor clarifications will be made to the instructions. The SHRM article lists three proposed revisions:
- Employers may designate anyone to be an authorized representative to complete Section 2 on the form. This addresses difficulties some employers face in completing the form for remotely hired employees.
- Entering “N/A” in the identity-document columns that are not used will no longer be required.
- I-9’s List C documents include a Social Security Card and birth certificate, but do not include a worker’s Employment Authorization Document (EAD). The EAD (Form I-766) is in List A.
