EEOC Requires Employers to Report 2017 & 2018 Pay Data
Employers are required to report pay data by race, ethnicity, and sex from both 2017 and 2018 payrolls. The report is due September 30. According to the May 2 EEOC announcement on their webpage, the agency plans to begin collection of EEO-1 Component 2 data in mid-July, 2019, and will notify filers of the precise date the survey will open as soon as it is available.
The deadline for employers to report “Component 1,” which gathers information on employee numbers by job category, race, sex and ethnicity, is May 31. The 30-day extension has been shortened to two weeks, as stated in the EEO-1 Survey.

While completing Component 2 with data pulled from employees’ W2s will require additional work for employers, the information will provide insight into pay practices across different industries and labor sectors.
Who is required to file the EEO-1 form?
According to this U.S. EEOC website, EEO-1 Frequently Asked Questions and Answers, these businesses must file an EEO-1 form annually:
- Companies subject to Title VII of the Civil Rights Act of 1964, as amended, and with 100 or more employees
- Companies subject to Title VII of the Civil Rights Act of 1964, as amended, with fewer than 100 employees if the company is owned by or corporately affiliated with another company and the entire enterprise employs a total of 100 or more employees
- Federal government prime contractors or first-tier subcontractors subject to Executive Order 11246, as amended, with 50 or more employees and a prime contract or first-tier subcontract amounting to $50,000 or more
