November 11 May Be Last Day to File Component 2 EEO-1 Reports

Deadline for filing Component 2 Data

Blue blocks with November 11 standing in front of clockAccording to an update posted on the EEOC (Equal Employment Opportunity Commission) Component 2 EEO-1 homepage, November 11, 2019 may be the final date for EEO-1 filers to submit and certify their Component 2 reports for 2017 and 2018.

In an earlier article, we reported that no end-date had been established for the filing extension. However, the October 24 EEOC update indicates that on October 8, EEOC put forth a court motion regarding Component 2 data collection after the previously announced deadline of September 30, 2019. Consistent with its current practice regarding Component 1 data, EEOC’s  collection of Component 2 data will continue for an additional six weeks, putting the final date at November 11. Additionally, since the EEOC had determined that Component 2 data collection should be considered complete once 72.2% of those reports were filed (75.9% had been filed as of October 8, 2019), EEOC also requested from the court an order confirming that the Component 2 data collection is complete.

The Plantiffs in this case (The National Women’s Law Center, et al.) do not agree. They believe the correct percentage for completion is 98.25%. Until the Court rules, the November 11 deadline is not firm. As stated in an article by Morgan Tanafon, if the court agrees with the plaintiffs, the deadline might be extended again.

As in its other updates, the EEOC encourages all filers to submit their data as soon as possible.
