EEOC Must Collect Component 2 Data through January 31, 2020
Filing Component 2 Data: The Story Continues
The filing deadline has again been extended. According to the October 30 update posted on the EEOC (Equal Employment Opportunity Commission) Component 2 EEO-1 homepage, until further notice, the final date for EEO-1 filers to submit their Component 2 reports for 2017 and 2018 is January 31, 2020.
On October 29, the U.S. District Court for the District of Columbia denied the EEOC’s October 8 motion for an order determining they had completed Component 2 data collection. Instead, the court issued an order that “… the EEOC must continue to take all steps necessary to complete the EEO-1 Component 2 data collection for calendar years 2017 and 2018 by January 31, 2020.”
Why the new date?
The arguments center on how to calculate the mean percentage of EEO-1 reports that had been submitted in previous years, since this is how the completeness of collection will be determined. The EEOC proposed that only EEO-1 reports submitted by the previous years’ deadlines should be included, resulting in a 72.7% mean percentage.
The plaintiffs in this case (The National Women’s Law Center, et al.) did not agree. They insisted the percentage be based on all EEO-1 reports that were filed in the previous years, including those filed after the deadline, resulting in a 98.3% mean percentage. The court agreed.

File as soon as possible
As in its other updates, the EEOC encourages all filers to submit their data as soon as possible.
